Welcome to MrJ Marketing (NZ). By accessing or using our website, digital content, consultancy services, courses, or applications (collectively, “Services”), you agree to these Terms of Service (“Terms”) under New Zealand law. Please read carefully.

Article 1. Acceptance of Terms

By accessing or using our Services, you accept and agree to be bound by these Terms.

If you do not agree, you must not use the Services.

Continued use of the Services constitutes acceptance of any updates to these Terms.

All content, branding, software, and materials provided by MrJ Marketing are protected by copyright, trademark, and other intellectual property laws.

Users may not copy, distribute, reproduce, or create derivative works without prior written consent.

As some Services are delivered via systeme.io, systeme.io’s terms also apply. Users must comply with systeme.io’s IP and usage policies.

Article 4a. Digital Content Ownership & Use

All digital content created and distributed by MrJ Marketing, including but not limited to emails, documents, videos, graphics, templates, guides, reports, and other materials (collectively, “Digital Content”), is the intellectual property of MrJ Marketing unless otherwise stated.

Users may not copy, reproduce, distribute, modify, sell, or create derivative works from any Digital Content without prior written consent from MrJ Marketing.

Any Digital Content provided to users (for example, via consultancy services, downloadable resources, or PLR content) is granted under a limited, non-transferable, non-exclusive license for personal or internal use only, unless a separate agreement specifies otherwise.

Users agree that any misuse of Digital Content may result in termination of access, legal action, and indemnification obligations under Article 5 (Indemnity).

All Digital Content is provided for informational and consultancy purposes only. Users acknowledge that outcomes may vary, and MrJ Marketing disclaims any liability for results arising from the use of Digital Content.

Article 4b. PLR & Resale Guidelines

Where Digital Content is sold or provided under Private Label Rights (PLR):

  • Users may edit, modify, or resell content only according to the included license.

  • Users may not claim authorship of original content.

  • Unauthorized sharing, redistribution, or commercial misuse is prohibited.

Violation of PLR or resale terms may result in termination, legal action, and indemnification obligations.

Article 4c. Affiliate Links

Some Services may contain affiliate links or references to third-party products/services.

Users acknowledge:

  • MrJ Marketing may receive compensation from these links.

  • No guarantees are made regarding performance, quality, or results of any third-party products.

  • Users are responsible for any decisions or actions taken based on affiliate promotions.

Article 5. Payment, Refunds & Subscriptions

  • All payments are processed through secure payment providers.

  • Digital products are generally non-refundable due to instant access.

  • Refunds may be granted at our discretion or as required by law.

  • Subscription cancellations are subject to platform rules; unused periods may not be refunded unless legally required.

Article 6. Email Marketing & Compliance

By providing your email, you consent to receive communications, newsletters, and promotional material from MrJ Marketing.

We comply with:

  • New Zealand’s Unsolicited Electronic Messages Act 2007.

  • Relevant anti-spam laws in other jurisdictions where applicable.

Users may unsubscribe at any time using the link in emails.

Article 7. User-Generated Content

Any testimonials, reviews, or feedback submitted may be used by MrJ Marketing for marketing or promotional purposes.

By submitting, users grant a non-exclusive, royalty-free, worldwide license to use such content.

Article 8. Disclaimers & Limitation of Liability

“As is” provision: Services are provided on an “as is” and “as available” basis. No warranties are provided except as required under New Zealand law.

Limitation of liability: To the maximum extent permitted by law, MrJ Marketing is not liable for:

  • Any indirect, incidental, consequential, or special losses arising from use of the Services.

  • Loss of profits, revenue, or data.

  • Errors, interruptions, or omissions in the Services.

Consumer Guarantees Act 1993: Nothing in these Terms excludes guarantees that cannot legally be excluded under the Act.

Indemnity: Users agree to indemnify and hold harmless MrJ Marketing, its affiliates, and partners against all claims, losses, liabilities, or expenses arising from violation of these Terms or misuse of the Services.

Use at own risk: All financial, consultancy, or digital content is used at the user’s own risk. Users are responsible for verifying third-party claims or services.

  • Data collected via systeme.io or third-party services used in delivering Services.

Upon termination, user data may be deleted according to systeme.io and MrJ Marketing retention practices.

Article 11. Governing Law & Dispute Resolution

These Terms are governed by New Zealand law.

Disputes shall first attempt resolution via mediation or arbitration.

If unresolved, disputes may be submitted to the New Zealand courts.

Article 12. Changes to Terms

MrJ Marketing may update these Terms at any time without prior notice, where legally permitted.

Continued use of the Services constitutes acceptance of revised Terms.

Article 13. Additional Protections & Disclaimers

  • Services, consultancy, and content are provided for informational purposes only. No financial, legal, or professional advice is implied.

  • Use of Services is at the user’s own risk.

  • MrJ Marketing disclaims liability to the fullest extent allowed by New Zealand law.

  • Force majeure: MrJ Marketing is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, or pandemics.
