Welcome to MrJ Marketing! By accessing or using our website, digital content, consultancy services, or applications (collectively, “Services”), you agree to these Terms of Service (“Terms”) under New Zealand law. Please read carefully.
Article 1 – Acceptance of Terms
By accessing or using our Services, you accept and agree to be bound by these Terms.
If you do not agree, you must not use the Services.
Continued use of the Services constitutes acceptance of any updates to these Terms.
Article 2 – Eligibility
You must be at least 16 years old with adult consent, or 18 years or older, to use the Services.
By using the Services, you represent and warrant that you meet this requirement.

As some Services are delivered via systeme.io, systeme.io’s terms also apply. Users must comply with systeme.io’s IP and usage policies.
Article 4a – Digital Content Ownership & Use
All digital content created and distributed by MrJ Marketing, including but not limited to emails, documents, videos, graphics, templates, guides, reports, and other materials (collectively, “Digital Content”), is the intellectual property of MrJ Marketing unless otherwise stated.
Users may not copy, reproduce, distribute, modify, sell, or create derivative works from any Digital Content without prior written consent from MrJ Marketing.
Any Digital Content provided to users (for example, via consultancy services or downloadable resources) is granted under a limited, non-transferable, non-exclusive license for personal or internal use only, unless a separate agreement specifies otherwise.
Users agree that any misuse of Digital Content may result in termination of access, legal action, and indemnification obligations under Article 5 (Indemnity).
All Digital Content is provided for informational and consultancy purposes only. Users acknowledge that outcomes may vary, and MrJ Marketing disclaims any liability for results arising from the use of Digital Content.
Article 5 – Disclaimers & Limitation of Liability
“As is” provision: Services are provided on an “as is” and “as available” basis. No warranties are provided, except as required under New Zealand law.
Limitation of liability: To the maximum extent permitted by law, MrJ Marketing is not liable for:
Any indirect, incidental, consequential, or special losses arising from use of the Services.
Any loss of profits, revenue, or data.
Any errors, interruptions, or omissions in the Services.
Consumer Guarantees Act 1993: Nothing in these Terms excludes guarantees that cannot legally be excluded under the Consumer Guarantees Act 1993.
Indemnity: Users agree to indemnify and hold harmless MrJ Marketing, its affiliates, and partners against all claims, losses, liabilities, or expenses arising from violation of these Terms or misuse of the Services.
Use at own risk: All financial, consultancy, or digital content is used at your own risk. Users are responsible for verifying any third-party claims or services.
Article 6 – Privacy Policy
6.1 Information We Collect
We collect personal information including but not limited to:
Name, email address, and other details voluntarily provided.
Automatically collected data such as IP address, device information, cookies, and analytics.
Note: Services delivered via systeme.io may also collect information as per their privacy policies. Users are responsible for reviewing systeme.io’s terms and policies.
6.2 Use of Information
We may use personal information to:
Provide, maintain, and improve Services.
Communicate with you regarding Services.
Comply with legal obligations under New Zealand law, including the Privacy Act 2020.
6.3 Sharing of Information
We do not sell personal information. Data may be shared with:

Termination procedures follow systeme.io policies where applicable.
Upon termination, user data may be deleted according to systeme.io and MrJ Marketing retention practices.
Article 8 – Governing Law & Dispute Resolution
These Terms are governed by New Zealand law.
Disputes shall first attempt resolution via mediation or arbitration.
If unresolved, disputes may be submitted to the New Zealand courts.
Article 9 – Changes to Terms
MrJ Marketing may update these Terms (including the Privacy Policy) at any time without prior notice, where legally permitted.
Continued use of the Services constitutes acceptance of revised Terms.
Article 10 – Additional Protections & Disclaimers
Services, consultancy, and content are provided for informational purposes only; no financial, legal, or professional advice is implied.
Use of Services is at the user’s own risk.
We disclaim liability to the fullest extent allowed by New Zealand law.
Force majeure: MrJ Marketing is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, or pandemics.
